SHOULD YOU FILE?

SHOULD YOU FILE  FOR BANKRUPTCY?

If you are thinking about filing for bankruptcy, take the time to know your options and your rights. Learn what bankruptcy is, what bankruptcy can and cannot do, the difference between Chapter 7 and Chapter 13 bankruptcy, alternatives to bankruptcy, and more.

Most people filing bankruptcy in Wisconsin will want to file under either chapter 7 or chapter 13. Either type of case may be filed individually or by a married couple filing jointly. Wisconsin also offers the chapter 128 alternative to bankruptcy those who wish to repay their debt with the help of a structured plan to get back on their feet. Below is just a quick overview of these three options. For more information, see the detailed comparison of Wisconsin's bankruptcy options which compares chapter 7 vs. chapter 13 vs. chapter 128.

Chapter 7

A Chapter 7 bankruptcy will discharge most types of unsecured debt. The trustee will sell any significant nonexempt property in order to repay your creditors.

Chapter 13

In Chapter 13 bankruptcy, you repay your creditors (some in full, some in part) through a Chapter 13 repayment plan.

Chapter 128

In Chapter 13 bankruptcy, you repay your creditors (some in full, some in part) through a Chapter 13 repayment plan.
